Stéphanie Cassimon

Fields

In recent years, Stéphanie has developed experience in disputes with a commercial or corporate law component and can rely on her knowledge of contract law, corporate law and judicial law. Her experience in legal disputes also helps Stéphanie anticipate aspects that may be decisive in legal proceedings when drafting agreements.

She approaches her cases from an advisory and proactive perspective, as well as with a procedural and reactive mindset.

Quick, reactive action is imperative when the preservation of assets is at risk, and Stéphanie acts accordingly, always with the utmost care for the interests of her clients and with the necessary attention to detail.

Despite her procedural enthusiasm, she believes that in certain cases an amicable solution is preferable to a possible years-long and unpredictable legal battle. In such situations, Stéphanie takes into account the human aspect and psychological toll that a lengthy procedure can take. In the amicable negotiations she conducts, she takes a pragmatic approach in order to reach a balanced solution allowing the client to accept the compromise reached. However, if an amicable solution proves impossible, she turns to the (summary proceedings) court without hesitation and fiercely defends the interests of her client.

Subject Matters

Cases which have already led to a dispute or are very likely to become contentious make up a significant part of the cases handled by Stéphanie with great dedication.

She has already handled various divorce cases in which private life and professional activities were intertwined and a separation was required on both a personal and business level.

Stéphanie also assisted several clients in the context of inheritance disputes, including disputes with a criminal nature.

Stéphanie also monitors commercial litigation that may involve various aspects and for which cross-fertilisation between different legal areas is assumed. For example, she has frequently defended the interests of individuals confronted with liability claims, including but not limited to accountants, directors and members of the supervisory board of companies. She has also frequently enforced compliance with contractual obligations with regard to clients. In addition, she also regularly receives post-acquisition cases. Recently, she successfully assisted a client who was confronted with an indemnification claim following the transfer of a client portfolio.

Stéphanie also represented the interests of a multinational company which was the victim of an international fraud scheme set up by one of its employees. Thanks to the extensive international network of Tuerlinckx Tax Lawyers, it was possible to act quickly in various jurisdictions in order to recover as much of the embezzled assets as possible.

Stéphanie also defended a family-owned company which faced implementing directives for the personal debts of a former partner, as well as the owner of various artworks which had to be recovered from an on-going bankruptcy procedure.

Other recent cases include a more proactive function such as drafting loan agreements, surety agreements, general terms and conditions in Dutch, French and English or advising on the restructuring of a family-owned company and the privately held property assets of the respective family, which often involves setting up a partnership.

Stéphanie is also experienced at advising on succession planning, and has assisted clients with formalising manual donations.
