At the moment, Belgium has no specific legislation regarding crypto assets. For this reason, such investments are governed by the general rules of the Income Tax Code. These rules were written long before the emergence of Bitcoin and their application to crypto currencies can be very ambiguous. The issues affecting cryptocurrency investors can be divided into four areas:
- Capital gains tax: capital gains on crypto currencies may be taxed as professional income, miscellaneous income or can be completely untaxed. Figuring out which regime applies to you is no easy task and depends entirely on the specific facts of your case. With our years of experience with crypto currencies and classic tax rules in general, we can advise you very clearly which regime applies to your investments;
- Tax on income in crypto coins: have you been mining? Have you staked your money? Or have you thought about yield farming or received an airdrop or experienced a fork? From a legal perspective, these phenomena all constitute income, on which taxes are payable in some cases.
- Tax compliance: The mere possession of crypto currencies can trigger certain reporting requirements. In tax matters, prevention is better than cure. We will help you complete the various formalities related to your investments in crypto currencies.
- Returning your crypto assets to fiat: how can you ensure that you enjoy the fruits of your investments worry-free? Belgian banks currently view crypto currencies with suspicion, accepting only those files that are in order from start to finish. Together with you, we can review how to prepare your case for entry into the bank
